These terms and conditions (“Agreement”) govern the participation of the affiliate (“Affiliate”) in the affiliate program (“Program”) of AdvantagePerks (“Company”). By participating in the Program, Affiliate agrees to the terms and conditions outlines in this Agreement.
1. Enrollment in the Program
To enroll in the Program, Affiliate must submit an application through the Company’s website. The Company reserves the right to accept or reject any application in its sole discretion. Once accepted, Affiliate will receive a unique referral link and access to the Company’s affiliate portal.
2. Promotion of Company’s Products/Services
Affiliate agrees to promote the Company’s products/services through their website, social media, email marketing, or other marketing channels. Affiliate must use their unique referral link to ensure proper tracking and crediting of sales. Affiliate must not engage in any deceptive or unethical marketing practices, including but not limited to false advertising or spamming.
The Company will pay Affiliate a commission on all sales referred by Affiliate through their unique referral link. The commission rate will be determined by the Company and may vary based on the product/service sold. The Company reserves the right to change the commission rate at any time.
The Company will pay Affiliate on a monthly basis for all eligible commissions earned during the previous month. Payments will be made through Stripe or another agreed-upon payment method. The Company may withhold payment for any sales that are fraudulent, cancelled, or returned.
Either party may terminate this Agreement at any time with or without cause. The Company may terminate this Agreement immediately if Affiliate engages in any prohibited activities or violates any of the terms and conditions set forth in this Agreement. Upon termination, Affiliate will no longer be eligible to receive commissions for any sales referred after the termination date.
Affiliate agrees to keep all confidential information related to the Company, including but not limited to commission rates and customer information, confidential and not to disclose such information to any third party.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located, without giving effect to any principles of conflicts of law.
8. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.
By enrolling in the Program, Affiliate agrees to be bound by the terms and conditions set forth in this Agreement.
